Fraudelent Bankruptcy in Hungarian Criminal Law

The study presents the key historical antecedents and current regulation of fraudulent bankruptcy in Hungarian criminal law. It examines certain provisions of the criminal code related to which regulatory dilemmas or possible anomalies can be identified and offers de lege ferenda proposals for their resolution and elimination. The second part of the paper explores issues connected to the application and the interpretation of the law concerning fraudulent bankruptcy, with a particular focus on the victim of fraudulent bankruptcy, considering that the judicial practice in this field has become notably divided, and the scholarly assessments in criminal law also show significant discrepancies.
