In the course of the codification of the Civil Code, the legal literature has been sharply critical of the codification of the franchise contract, both in terms of the necessity of the regulation and the content of the normative material. This study aims to give new impulses to this debate by applying a legal economics perspective, which can be found at several points in the legislation of the United States of America.
