The system of legal remedies for consumer protection in Hungary, with special regard to the right to bring a claim before a judge

The consumer redress system in Hungary is of paramount importance in protecting citizens’ rights and ensuring market justice. The legal framework and the related judicial procedures define the mechanisms for enforcing consumer rights. The Hungarian consumer protection legal system is based on the Consumer Protection Acts, which are developed on the basis of EU directives. The legislation sets out in detail the rights of consumers and the obligations of businesses. An important element is the regulation of unfair commercial practices, product warranties and distance contracts. Consumer redress is mainly through the civil courts. The redress mechanisms available to consumers include claims for damages and negotiation of claims arising from breach of contract. Court procedures have well documented and transparent processes. Although the Hungarian consumer protection legal system has made significant progress in protecting consumers, challenges remain. Procedures can be lengthy and access to redress can sometimes be difficult for consumers. The growth of digital commerce and online shopping poses further challenges for the legislator.The consumer redress system in Hungary has made significant progress in protecting consumers’ rights. However, further improvements and fine-tuning of the legal system should allow it to adapt to new challenges. Such new challenges may include, but are not limited to, environmental concerns, global trade, the development of new technologies or digital trade and online shopping.
