Economy and Private Law – Private Economic Law: In the Light of the Work of Ödön Kuncz

Private economic law is the result not only of the interweaving of several disciplines but also of the merger of several “sub-disciplines”. Within this field, too, the institution of the promissory note is of particular importance, as it is a phenomenon of not only contract law but also of business and economic life, and it has created a very specific world of ideas in relation to the law of promissory notes. At the same time, economic law is based on strong moral foundations, human characteristics, and humanity. All these moral, economic, and private law foundations bind the legislator himself as well. The principles – of which the general requirement of business integrity, as the fairness of the trader towards both competitors and consumers, is of particular importance – bring into the code the minimum standards of conduct that society has formulated, accepted, and deemed to follow. The present study aims to illustrate these features of private commercial law through the work of Ödön Kuncz.
